  • Class of 2028 J.D. Student
  • The ability to work independently and as part of a team, and a commitment to the highest quality of client service
  • Law journal experience and GPA in the top quarter of class are strongly preferred.

The legal assistant will maintain positive contact with clients, attorneys and staff and observe confidentiality of client matters.

 
This is a hybrid position with in-office requirements in our Austin, TX office.
 
What You’ll Do
  • Provide administrative and legal support to attorneys in managing domestic and international trademark client portfolios.
  • Assist with filings, maintenance, and correspondence with clients and trademark offices such as the United States Patent and Trademark Office.
  • Draft and prepare correspondence, legal documents, and emails from written or oral instructions
  • Manage calendars, schedule meetings, coordinate travel (domestic and international), and maintain deadline reminders
  • Handle phone calls, voicemail, mail, and internal electronic filings; ensuring timely document routing and delivery
  • Maintain organized client files both physical and electronic.
  • Conduct internal preliminary trademark conflict searches

We are seeking a Trademark Associate to join our firm. For candidates in the Austin, Texas area, this is a hybrid position with in-office requirements. Out-of-state candidates will be considered for a fully remote position.

Pirkey Barber works with a broad range of clients across multiple industries such as for-profit and non-profit companies, foreign entities, and religious organizations. The successful applicant will be required, as an essential function of this job, to advocate on behalf of their clients.

What You’ll Do

  • Manage and conduct U.S. and international trademark clearance searches and provide practical opinions to clients on risk and brand strategy.
  • Handle trademark prosecution matters including filing of U.S. applications, responses to office actions, and maintenance of global trademark portfolios.
  • Assist clients with brand protection, including monitoring and routine enforcement. Depending on the experience of the candidate, the role may also involve opposition/cancellation proceedings before the Trademark Trial and Appeal Board (TTAB) or trademark litigation.
  • Counsel clients on domain name issues, social media handles/brands, licensing and assignment of trademarks.
  • Interface directly with clients — advising in-house legal and brand teams on brand rollout, portfolio management, anti-counterfeiting efforts, and clearance enforcement.

Qualifications

  • J.D. from an accredited law school with an active Texas state bar license or eligibility to waive into the Texas bar
  • 2-7 years of full-time (or equivalent) experience in trademark law, including prosecution, clearance, enforcement or portfolio management. Experience in TTAB or IP litigation is a plus but not required.
  • Strong experience in trademark clearance, filing strategies, responses to USPTO office actions, and international trademark prosecution.
  • Excellent writing, research, analytical and project-management skills; ability to work independently and collaboratively in a fast-paced environment.
  • Experience managing competing priorities, multiple client matters and deadlines; highly organized, detail-oriented and business-minded.
  • Strong interpersonal and client-service skills; willingness to engage in client calls, deliver strategic advice and build relationships.

We are seeking a full-time Trademark Attorney with at least three years of full-time equivalent experience in trademark law to join our firm.

This position is an alternative to traditional partnership-track positions and features a lower billable hour requirement. Unlike traditional partnership-track positions, this position does not require business development or other significant non-billable work. Remote candidates are encouraged to apply. Attorneys local to Austin TX are welcome, but not required, to work in-office.

What You’ll Do

You’ll do one or more of the following, depending on experience and interests:

  • Manage and conduct U.S. and international trademark clearance searches and provide practical opinions to clients on risk and brand strategy.
  • Handle trademark prosecution matters including filing of U.S. applications, responses to office actions, and maintenance of global trademark portfolios.

Qualifications

  • J.D. from an accredited law school with an active state bar license in at least one U.S. jurisdiction
  • At least three (3) years of full-time equivalent experience in one or more of the following trademark areas: clearance, U.S. prosecution, U.S. and international portfolio management, routine enforcement, TTAB proceedings, or trademark litigation
  • Strong academic credentials

We are seeking a full-time Trademark Docketing Clerk with at least two years of full-time equivalent experience in trademark law to join our firm. Trademark Docketing responsibilities include: handling docketing and document management functions related to all trademark prosecution and contested matters (TTAB and litigation); docketing of inbound, outbound, and internal communications; providing support services to attorneys, paralegals, and legal assistants as requested.

What You’ll Do

  • Create new records as needed and assist in the docketing of transferred cases
  • Review and develop internal policies and procedures related to docketing
  • Ensure that loss of rights deadlines are cleared in accordance with firm policies
  • Assist with ensuring the integrity of internal and external contacts maintained in the database and handle global updates or reassignment of contacts as needed
  • Prepare reports and assist other department staff in the preparation of reports; customize standard reports as needed
  • Assist with client and firm projects as needed
  • Assist in ensuring the smooth operations of docketing support functions during their absence
  • Assist in training new assistants, paralegals, and associates on docketing processes and/or software as directed

Qualifications

  • At least 2 years' experience with the trademark prosecution process within a law firm setting is required
  • Bachelor's degree preferred
  • A comprehensive understanding of PTO rules and procedures for obtaining and maintaining trademark protection worldwide
  • Ability to apply that knowledge to review and docketing of inbound, outbound, and internal communications and related docketing requests
  • Ability to work under tight deadlines and handle multiple, detailed tasks; availability to work overtime as needed
  • Ability to plan, organize and carry out multiple related activities
  • Excellent communication skills (oral, written, and interpersonal) and attention to detail with ability to follow up and follow through
  • Strong computer skills, including Microsoft Word, Excel, and Outlook; and a demonstrable ability to learn any department-specific software

What You'll Do:

  • Manage and maintain litigation and policing client/matter files including official papers.
  • Prepare complaints, notices of opposition, petitions for cancellation, answers, discovery requests and responses, subpoenas, deposition notices, declarations, motion related documents, proposed orders, exhibit appendices, and correspondence.
  • Assist with document collection processes, including identifying documents responsive to discovery requests, and overseeing document production.
  • E-file documents in various courts and administrative agencies, including but not limited to all Federal Courts, U.S. Court of Appeals (all Circuits), USPTO Trademark Trial and Appeal Board, and the Forum (domain name dispute proceedings), and state court.
  • Perform factual and legal cite checking of motions and briefs utilizing key cite checking authorities.
  • Prepare materials for and assist attorneys with court proceedings including but not limited to hearings, depositions, arbitration, and trial.
  • Coordinate with external vendors.
  • Maintain physical and electronic files.
  • Review incoming correspondence, determine appropriate action.
  • Review and maintain docket and update as appropriate.
  • Share responsibility with attorneys for meeting all deadlines.
  • Maintain daily timekeeping for billing purposes, entering time records daily.

Qualifications

  • Education: Bachelor's degree and/or paralegal certification from an ABA-approved program.
  • Experience: Four to seven (4-7) years as a Litigation Paralegal within a law firm setting, including federal district court civil litigation
  • Strong knowledge of federal court rules and procedures
  • Experience with software such as document management, records management, docket management, research tools, and Pacer
  • Excellent organizational skills with the ability to manage multiple cases and deadlines.
  • Must be flexible, well organized, and able to adapt to change.
  • Strong written and verbal communication skills.
